Introduction to MonkeyZoo©

​Welcome to MonkeyZoo. MonkeyZoo is an original collection of 30 characters, each with 300 unique versions of the image minted on the Chia blockchain.

MonkeyZoo NFTs come with a full personal and commercial licence to use the MonkeyZoo brand and images. 

MonkeyZoo hopes to bring joy to everyone and resonate with their owners and people who see them.

1. Ownership

What You Own

You own your purchased MonkeyZoo NFT.

MonkeyZoo NFTs are minted on the Chia blockchain.

When you purchase that NFT you own the underlying elements, attribute art and final composition of the individual monkey characters art. Since MonkeyZoo NFTs collection contain multiple attributes, all attribute art assets are shared amongst all MonkeyZoo NFT owners.

 

You will only own the grants, licence and rights of the specific original MonkeyZoo character that you own.  You may however own more than one MonkeyZoo character NFT and gain the grants, licence and rights of multiple MonkeyZoo characters.

You may only use the associated attributes that come with the original MonkeyZoo characters you own, or any additional MonkeyZoo attributes you purchase separately from the marketplaces. (For example you may not use traits from Nurse monkey unless you own the NFT Nurse monkey or new attributes brought from the MonkeyZoo marketplace)

All NFTs ownership is verified cryptographically on the Chia blockchain. This is proof of ownership and grants rights within this document. Once the NFT leaves ownership, all personal and commercial use terms are revoked.

What We Own

The name and intellectual property involved in the MonkeyZoo NFT project (“MonkeyZoo”) is owned by the team here at MonkeyZoo.

MonkeyZoo is a trademark protected brand, owned by MonkeyZoo Ltd.

All rights that are not specifically granted to the users and owners of MonkeyZoo NFTs below are reserved by the team.

This includes but is not limited to the intellectual property rights surrounding the images, names, logos, 3D layer files, trademarks, the website, the ability to mint 3D or voxel or other versions of MonkeyZoo characters, the smart coin contract code, or anything else not specifically granted by any of the commercial or public licenses.

We also own all original MonkeyZoo images that will be minted on the Chia blockchain and held in our own MonkeyZoo portfolio.

We own the royalty percentage of the sell on fee that is minted into the MonkeyZoo NFT.

3. Licences

Commercial Use Licences

MonkeyZoo grants you an unlimited royalty-free license to use, copy and display your owned MonkeyZoo characters NFT art including associated asset art. This usage is granted world-wide for the purpose of creative derivative works based on the owned NFT as outlined below: 

• Personal and commercial use.

• Produce and sell merchandise up to an annual turnover of £100,000 (or a countries equivalent currency value) for apparel, printed art, clothing stickers or any other physical objects you may wish to sell.

• Usage in print (comics, graphic novels, posters, animated series).

• Display and use your NFT on external websites and social media.

• Ability to buy, sell, and trade your NFT.

• Deconstruct for usage of displaying trait asset art associated with your owned MonkeyZoo character.

• Usage of the MonkeyZoo name icon and logo for personal and commercial uses.

• We don’t want to see any other projects utilizing our individually crafted layers, so you may not mint new NFTs that are derivatives of our project, change the original MonkeyZoo artwork, or mint another full project using our MonkeyZoo characters in any way.

• Other than that, you may create whatever merchandise you would like up to an annual turnover of £100,000 GBP (or a countries equivalent currency value), and should you approach that number or expect to go beyond it please reach out to the team and we’ll discuss a licensing deal for anything beyond that amount.

Personal Use Licences

MonkeyZoo grants you an unlimited royalty-free license to use, copy and display your owned MonkeyZoo characters NFT art including associated asset art. 

• Personal use only..

• Ability to buy, sell, and trade your NFT.

• We don’t want to see any other projects utilizing our individually crafted layers, so you may not mint new NFTs that are derivatives of our project, change the original MonkeyZoo artwork, or mint another full project using our MonkeyZoo characters in any way.

4. Excluded Use

These terms exclude you from the following:

• Duplicating and reselling your MonkeyZoo NFT as a newly minted NFTs without 80% or more modifications to the original art.

• Using your MonkeyZoo traits as elements on newly minted non MonkeyZoo NFTs without 80% or more modifications to the original art.

• Mixing of the original MonkeyZoo traits unless you own the associated MonkeyZoo character or attribute NFT.

• Use the MonkeyZoo characters, traits or branding in any video animation, unless the video animation has been first agreed by MonkeyZoo.

• Creating offensive or any images that Monkeyzoo deems unsuitable to the Monkeyzoo brand.

• The use of the word MonkeyZoo in your own website domain or subdomain name is prohibited.

5. Definitions

The following capitalized terms will have the following meanings:

• “Art” means any art, design, and drawings that may be associated with a MonkeyZoo NFT that you own.

• “Own” means, with respect to a MonkeyZoo NFT, a MonkeyZoo NFT that you have purchased or otherwise rightfully acquired from a legitimate source, where proof of such purchase is recorded on the Chia blockchain.

• “Purchased MonkeyZoo” means a MonkeyZoo NFT that you own.

• "Trait or asset or attribute" means the art associated with each graphic trait and its associated MonkeyZoo character. This includes any attributes listed in our attribute assets as defined in our code.

MonkeyZoo retains the ownership of the MonkeyZoo name and logo. As well as rights to use, modify and distribute all minted NFTs for use of marketing and promotional purposes. MonkeyZoo retains ownership and rights to distribute, copy, and modify MonkeyZoo trait asset art, commercially and as NFTs.

MonkeyZoo NFTs are not intended as investments MonkeyZoo NFTs are meant to be a fun Non-Fungible Token for you to collect. They are not meant as investment vehicles. We make absolutely no promise or guarantee that these NFTs will be worth anything more than what you and the market deem the art to be worth. This could very well be zero. You understand that they have no inherent monetary value, and they should be treated as nothing more than a collectible with potential future value or lack thereof.

6. Additional traits or attributes

To ensure consistency and ensure that MonkeyZoo characters and attributes are still on the blockchain, only MonkeyZoo will be allowed to mint official additional MonkeyZoo additional art.

Any unofficial additional art not minted by MonkeyZoo and added to MonkeyZoo characters or imagery will void the above licence agreements.

7. Upgrading NFTs

The process for NFT upgrading:

• Present MonkeyZoo with all of the NFTs you would like to combine.

• MonkeyZoo will check that all attributes and your MonkeyZoo character are genuine MonkeyZoo artwork that have been minted on the blockchain and are connected with the MonkeyZoo DID.

• MonkeyZoo will work out what the new rarity score and $MZ Yield will be by combining the rarity and yield values of all combined assets, traits, attributes and character base layer.

• MonkeyZoo will then create a new MonkeyZoo character base layer NFT and its associated traits, assets or attributes that you are combining to enable us the ability to mint a new NFT with the same MonkeyZoo number.

• All of the "old" NFTs will be merged into the singular new NFT.

• The original MonkeyZoo character NFT will be stored within the new Character NFT.

• For a small charge MonkeyZoo will mint the new character and add the new metadata and DID to the new NFT along with the original MonkeyZoo number from the original MonkeyZoo character NFT.

• You will then receive the newly created MonkeyZoo character keeping its original MonkeyZoo number. 

• This new bespoke MonkeyZoo character is owned by you and falls under the MonkeyZoo licensing agreement associated with the unique MonkeyZoo number. This means you may continue to display and use the image for private and commercial uses.

The outside designer agreement

If a designed attribute or new MonkeyZoo character is agreed by MonkeyZoo it will be minted onto the Chia blockchain by MonkeyZoo and the designer will receive 50% of all initial sale revenue.

The other 50% of the initial sale revenue will go to MonkeyZoo.

Royalties will be set at 7.5% and will be directed to MonkeyZoo.

The designer and MonkeyZoo will agree and decide on the listing price of the attribute and the quantity minted of said attribute or base layer character.

Only MonkeyZoo can mint official MonkeyZoo attributes or base layer characters. MonkeyZoo will add the new artwork to the MonkeyZoo portfolio, NFT metadata and Chia DID.

MonkeyZoo will then own the rights to any new artwork added to the MonkeyZoo portfolio.

MonkeyZoo will then sell the NFT via our chosen marketplaces for the initial sale of the NFT attribute.

MonkeyZoo will advertise the design on its social media channels, website and marketplaces.

8. Disclaimer

Our artwork and characters are an original style. We are not affiliated with or sponsored by any of the original characters or brands that are alluded to in our works.​

MonkeyZoo token disclaimer

• MonkeyZoo token is not an investment and should not be considered an investment.  The gifted MonkeyZoo tokens are based on individual involvement in the MonkeyZoo community and hold no monetary value.

• Do not expect profit from the MonkeyZoo token.  We are not financial advisors and any of our messages is not financial advice. 

• MonkeyZoo token holds no current monetary value and is intended for use in games, metaverses and to swap for Monkeyzoo NFTs, they are in no way intend to be a security.

• MonkeyZoo is not a common enterprise.

Taxes

You are entirely responsible for any tax liability which may arise from reselling your MonkeyZoo NFTs.

You are responsible for any tax liability which may arise from you selling any MonkeyZoo merchandise or prints.

You are responsible for the tax on the 50% earned through the design and creation of additional attributes or base layer characters sales.

You are responsible for the tax of MonkeyZoo token $MZ gifted through holding MonkeyZoo NFTs in your wallet. 

Children

The MonkeyZoo project is not targeted towards children. You are not to aim your own MonkeyZoo merchandise or prints towards children which are inappropriate. 

 

To purchase a MonkeyZoo NFT, you must be over the age of 18 or above the legal age in your jurisdiction; whichever is greater.

Links to this website and these Terms and conditions contained within this document are also contained within the individual metadata of each NFT.

10. MonkeyZoo Token

MonkeyZoo token or $MZ is the native token of the MonkeyZoo product. It's purpose is to be a perk and a gift to holders of MonkeyZoo NFTs to be used to purchase NFTs and in the future to be used in metaverses as in game currency. It also acts as a way to partake in the governance of the MonkeyZoo project and allow holders to have an influence on some decisions in the future.

11. Special edition NFT's

On occasion Monkeyzoo will mint and release special edition Monkeyzoo NFT's.

These special edition NFT's are collectable items only and hold no monetary value.

These NFTs hold the personal usage license only.

These NFT's will not self gift $MZ token and can not be upgraded or used as a base layer for other community driven designs.

These terms are subject to change

• These terms may be discretionarily modified or replaced at any time, unless stated otherwise herein.

• The most current version of this agreement will be posted on the website with the “last revised” date at the top of the agreement changed.

• Any changes or modifications will be effective immediately upon posting the revisions to the site.

• You shall be responsible for reviewing and becoming familiar with any such modifications.

• You waive any right you may have to receive specific notice of such changes or modifications.

• Use of the platform by you after any modification to the agreement constitutes your acceptance of the agreement as modified.

• If you do not agree to the agreement in effect when you access or use the platform, we may, at any time and without liability or prior notice, modify or discontinue all or part of the platform (including access to the platform via any third-party links).

Delivery when will I get my order?

Usually, it takes 3–7 days to fulfil an order, after which it’s shipped out. The shipping time depends on your location, but can be estimated as follows:

• USA: 3–4 business days

• Europe: 6–8 business days

• Australia: 2–14 business days

• Japan: 4–8 business days

• International: 10–20 business days

Current delays

Our fulfilment times may be longer than usual and may continue to increase until things get back to normal. We're seeing delays in our supply chain, including distributors and shipping carriers as the entire industry is grappling with challenges. It's currently difficult to predict the shipping times.

Where will my order ship from?

We work with an on-demand order fulfilment company with facilities worldwide.

​

Will I be charged customs for my order?

An additional customs and tax fee can occur on international orders. This fee is not in our control and is assessed by your local customs office. Customs policies vary widely for every country so please check with your local customs office directly to see if they apply duties and taxes to your purchases.

My order should be here by now, but I still don't have it. What should I do?

Before getting in touch with us, please help us out by doing the following:

• Check your shipping confirmation email for any mistakes in the delivery address.

• Ask your local post office if they have your package.

• Stop by your neighbour's in case the courier left the package with them.

If the shipping address was correct, and the package wasn't left at the post office or at your neighbour's, get in touch with us at support@monkeyzoo.net with your order number.

How are your products made?

We work with a print-on-demand drop shipper. They have locations worldwide, so depending on where you are, your orders are printed and shipped from the facility that can do it most efficiently.

How do I track my order?

You will receive a tracking link via email when your order ships out. If you have any questions about your tracking or shipment, drop us a line at support@monkeyzoo.net.

I received a wrong/damaged product, what should I do?

We are so sorry if the product you ordered arrived damaged. To help us resolve this for you quickly, please email us at support@monkeyzoo.net within a 7 day period with photos of the damaged product, your order number, and any other details you may have about your order. We’ll get back to you with a resolution as soon as possible.

What is your return policy?

Do you offer refunds?

Refunds are only offered to customers that receive the wrong items or damaged items. If any of these apply, please contact us at support@monkeyzoo.net with photos of wrong/damaged items and we’ll do our best to sort that out for you.

Can I exchange an item for a different size/colour?

At this time, we don't offer exchanges. If you’re unsure which size would fit better, check out our sizing charts; we have one for every item listed on our store in the product description section. Though rare, it's possible that an item you ordered was mislabelled. If that’s the case, please let us know at support@monkeyzoo.net within a week after receiving your order. Include your order number and photos of the mislabelled item, and we’ll send you a new one, or issue a refund.

This website is owned and operated by MonkeyZoo Ltd. These terms set forth the terms and conditions under which you may use our website and services as offered by us. This website offers visitors the ability to purchase MonkeyZoo branded goods. By accessing or using the website of our service, you approve that you have read, understood, and agree to be bound by these Terms.

In order to use our website and/or receive our services, you must be at least 16 years of age, or of the legal age of majority in your jurisdiction, and possess the legal authority, right and freedom to enter into these terms as a binding agreement. The prices we charge for our products are listed on the website. We reserve the right to change our prices for products displayed at any time, and to correct pricing errors that may inadvertently occur. Additional information about pricing and sales tax is available on the payments page.

We may permanently or temporarily terminate or suspend your access to the service without notice and liability for any reason, including if in our sole determination you violate any provision of these terms or any applicable law or regulations. You may discontinue use and request to cancel your account and/or any services at any time.
